In these Terms, "you", "client", "member" and "your" refer to the individual or entity that creates a NatureMDs account as a customer. "Optimum Wellness Consultant", "Consultant" and "they" refers to a freelance consultant who answers your queries and enquires. “NatureMDs” and “we” refer to the NatureMDs platform.
‘Private Area’ refers to all areas of the NatureMDs platform which require registration and/or client login. ‘Public Areas’ are all areas of the site which do not require registration or logging in to.

The NatureMDs site serves as a platform and medium in connecting members and Optimum Wellness consultants. NatureMDs makes no warranty as to the content of information in the public or private areas. You and your Optimum Wellness consultant are solely responsible for all information and/or communication relayed in the private area. Nothing contained in the public or private areas should be construed, directly or indirectly, as the practice of medicine or dispensing of medical services by NatureMDs. The use of NatureMDs is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Optimum Wellness consultants do NOT diagnose, or claim to treat or cure any condition. NatureMDs does not guarantee that any of its offered services are the appropriate course of treatment for your particular health care problem and will not be held liable for any loss or damage caused by your reliance on any information or content contained in any of the NatureMDs services. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read, seen, heard, or in any way obtained on the NatureMDs site. You agree to contact your physician immediately should your condition change or your symptoms worsen.

NatureMDs does not necessarily recommend or endorse any specific tests, consultants, products, procedures, opinions, or other information that may be mentioned on the site. Reliance on any information provided through NatureMDs, others appearing on the site at the invitation of NatureMDs, or other visitors to the site is solely at your own risk. We do not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information displayed, uploaded or distributed through the Service by us, our partners or any member or any other person or entity. You acknowledge that any reliance upon such opinion, member profile, advice, statement or information is at your own risk. We are not responsible for the conduct, whether online or offline of our members. Please use caution and common sense when using the Website and the Service.

Liability of NatureMDs and its Licensors
The use of the NatureMDs Site and the Content is at your own risk.
When using the NatureMDs Site, information will be transmitted over a medium that may be beyond the control and jurisdiction of NatureMDs and its suppliers. Accordingly, NatureMDs assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the NatureMDs Site.
The NatureMDs site and the content are provided on an "as is" basis. NatureMDs, its licensors, and its suppliers, to the fullest extent permitted by law, disclaim all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights, and fitness for particular purpose.
Without limiting the foregoing, NatureMDs, its licensors, and its suppliers make no representations or warranties about the following:
1. The accuracy, reliability, completeness, currentness, or timeliness of the Content, software, text, graphics, links, or communications provided on or through the use of the Site.
2. The satisfaction of any government regulations requiring disclosure of information on products or the approval or compliance of any software tools with regard to the Content contained on the Site.
In no event shall NatureMDs, its licensors, its suppliers, or any third parties mentioned on the NatureMDs Site be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the NatureMDs Site or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not NatureMDs, its licensors, its suppliers, or any third parties mentioned on the NatureMDs Site are advised of the possibility of such damages. NatureMDs, its licensors, its suppliers, or any third parties mentioned on the NatureMDs Site are not liable for any personal injury, including death, caused by your use or misuse of the Site, Content, or Public Areas (as defined below).
Any claims arising in connection with your use of the Site, any Content, or the Public Areas must be brought within six (6) months of the date of the event giving rise to such action occurred and must be resolved by binding arbitration between you, the client, and NatureMDs.
Any claims arising in connection with your use of the Private Areas must be brought within six (6) months of the date of the event giving rise to such action occurred and must be resolved by binding arbitration between you, the client, and your Optimum Wellness Consultant. NatureMDs is not responsible for any data, information, recommendations or advice that is given by an Optimum Wellness consultant in any of the Private Areas.
If there is any dispute about or involving the Website and/or the Service, by using the Website, you agree that the dispute will be governed by the laws of Cyprus and without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the courts of Cyprus. Use of this Website is unauthorized in any jurisdiction where the Website or any of the Content may violate any laws or regulations. You agree not to access or use the Website in such jurisdictions. You agree that you are responsible for compliance with all applicable laws or regulations. Any contravention of this provision (or any provision of this Agreement) is entirely at your own risk. The Website is operated by the Owner from its offices within the territory of Cyprus. You agree that all matters relating to your access or use of the Website and its Content shall be governed by the laws of the territory of Cyprus and the laws of Cyprus applicable therein, without regard to conflict of laws principles. You agree and hereby submit to the exclusive and preferential jurisdiction of the courts of Cyprus with respect to all matters relating to your access and use of the Website and the Content as well as any dispute that may arise there from and that the applicable law shall be the law of Cyprus.
You are solely responsible for your interactions with the service. NatureMDs makes no representation or warranty as to the conduct of its consultants or their ability with any current or future conversations. You agree to take reasonable precautions in all interactions with consultants of the service. You understand that NatureMDs makes no guarantees, either express or implied, regarding your ultimate satisfaction with the outcome.
Remedies under these Terms and Conditions are exclusive and are limited to those expressly provided for in these Terms and Conditions.
Your sole remedy for dissatisfaction with the site and/or site-related services is to stop using the site and/or those services.
If any part of this limitation on liability is found to be invalid or unenforceable for any reason, then the aggregate liability of NatureMDs under such circumstances for liabilities that otherwise would have been limited shall not exceed USD one hundred dollars ($100).
User Submissions
The personal information you submit to Nature MD’s is governed by the NatureMDs Privacy Policy. To the extent there is an inconsistency between this Agreement and the Privacy Policy, this Agreement shall govern.
You agree that you will not upload or transmit any communications or content of any type to the Private Areas that infringe or violate any rights of any party.
If you submit any business information, idea, concept or invention to NatureMDs by email, you agree such submission is non-confidential for all purposes.
You agree that you will not upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or this Web site.
By uploading any media like a photo or video, (a) you grant to NatureMDs a perpetual, non-exclusive, worldwide, royalty-free license to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in the media; and (b) you certify that any person pictured in the submitted media (or, if a minor, his/her parent/legal guardian) authorizes NatureMDs to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in such media; and (c) you agree to indemnify NatureMDs and its affiliates, directors, officers and employees and hold them harmless from any and all claims and expenses, including attorneys' fees, arising from the media and/or your failure to comply with these the terms described in this document.
Passwords
NatureMDs has several tools that allow you to record and store information. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your NatureMDs passwords or accounts. Please select a password that would not be obvious to someone trying to guess your password, and change it regularly as an added precaution. You are responsible for maintaining the confidentiality of the password and account, and you are fully responsible for all activities that occur under your password or account identification. Additionally, it is your sole responsibility to (1) control the dissemination and use of activation codes and passwords; (2) authorize, monitor, and control access to and use of your NatureMDs account and password; (3) promptly inform NatureMDs of any need to deactivate a password. You grant NatureMDs and all other persons or entities involved in the operation of the Site the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Site. NatureMDs cannot and does not assume any responsibility or liability for any information you submit, or your or third parties' use or misuse of information transmitted or received using NatureMDs tools and services.
Services
If you choose to subscribe to one of NatureMDs services, the following additional terms and conditions will apply depending on which service you choose. You should be aware that the NatureMDs Services are not intended or designed to attract minors under the age of 18. A parent or guardian, however, may use NatureMDs on behalf of a minor child or provide the minor with their consent.
Information you submit: You are using the Subscription Services at your own risk and you, along with your consultant, are personally responsible for verifying its suitability for your needs.
Charges and billing: NatureMDs works on a credit based system. In order to book a webcam session or request a message you must have sufficient credits in your account. All fees, cancelations and refunds are detailed in the ‘Charging Rules’ section. You are responsible for providing a valid credit card number when purchasing credits. You represent and warrant that you are an authorized user of such credit card, and you agree to pay all charges resulting from your Service account at the prices listed in the ‘Charging Rules’, including any unauthorized charges incurred prior to your notifying NatureMDs of such charges. You agree that NatureMDs may pass your credit card information and related personally identifiable information to its designated service provider(s) for their use in charging you for appropriate services utilized through your Service. NatureMDs reserves the right to modify or terminate membership plans, change prices, or institute new charges for any Service at any time.
Membership
Membership Terms & Pricing: Your membership term is determined by the type of membership you choose. Your membership is subject to our approval. NatureMDs retains the right to freeze, delete or terminate your account at any time without notice.
By using the ‘Optimum Wellness’ service you, the client, agree to the ‘Optimum Wellness’ conditions. Complete registration, including a valid email is required to open an ‘Optimum Wellness’ account. After the registration process you will be asked to complete a personal history form and upload any relevant medical results you may have. All information uploaded onto your personal profile page is highly secured and can only be viewed by your selected Optimum Wellness Consultants’ and a selective few NatureMDs staff members.
By using the ‘free trial’ service you, the client, agree to the ‘free trial’ conditions. During this free trial, you can register on NatureMDs and create a profile. However, you are not able to select your preferred Optimum Wellness consultant. Instead, your profile will be submitted to a free trial pool accessible to all Optimum Wellness consultants. The first Optimum Wellness consultant to view and accept your file will reply to you. The Optimum Wellness consultants’ initial free reply will be of introductory nature.
NatureMDs tries its best to do a background check on all the Optimum Wellness consultants, but cannot vouch for their qualifications. At times, NatureMDs will use an external company to check the Optimum Wellness consultants’ qualifications. It is the clients’ ultimate responsibility to inquire and perform a background check on all Optimum Wellness consultants. NatureMDs cannot verify the location or time zone the Optimum Wellness consultant is located in. The location and time zone displayed for the consultant does not necessarily indicate the consultants’ location. You, the client, are not committed to the use of one or any Optimum Wellness consultant and may use any number of Optimum Wellness consultants simultaneously to your liking.
You may freeze, reactivate or delete your NatureMDs profile as follows:

support@naturemds.org from the email account you submitted to NatureMDs when registering on the NatureMDs website and indicate within the body of the message your intent to cancel. Be sure to include your first and last name and username.
Private Area
NatureMDs and its licensors are not responsible for the consequences of any communications in the Private Areas. In consideration of being allowed to use the Private Areas, you agree that the following actions shall constitute a material breach of these Terms and Conditions:
1. Using a Private Area for any purpose in violation of local, state, national, or international laws;
2. Posting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;
3. Posting material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by NatureMDs in its sole discretion;
4. Posting advertisements or solicitations of business;
5. After receiving a warning, continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form);
6. Posting chain letters or pyramid schemes;
7. Any fraudulent activity, including, but not limited to, impersonating another person;
8. Distributing viruses or other harmful computer code;
9. Allowing any other person or entity to use your identification for posting or viewing comments
10. Attempting to disable, bypass, modify, defeat or otherwise circumvent any of the digital rights management or other security related tools incorporated into the software or any Content or the Site.
11. Creating derivative uses of the Site or the Content.
NatureMDs reserves the right (but is not obligated) to do any or all of the following:
1. Record the dialogue in private webcam rooms.
2. Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).
3. Remove communications which are abusive, illegal, or disruptive, or that otherwise fail to conform with these Terms and Conditions.
4. Terminate a user's access to any or all Public and Private Areas and/or the NatureMDs Site upon any breach of these Terms and Conditions.
5. Edit or delete any communication(s) posted on the Site, regardless of whether such communication(s) violate these standards.
Nature MD’s or its licensors have no liability or responsibility to users of the Nature MD’s Site or any other person or entity for performance or nonperformance of the aforementioned activities.
Interactive Session & Personal Messages Terms
Booking an interactive session:
All interactive sessions need to be booked at least 24 hours ahead of time. Booking an interactive session within less than 24 hours is considered an ‘emergency session’.
In order to book an interactive session you will need to have sufficient credits in your account. Once you have booked an interactive session, these credits will be ‘reserved’ either until the session has been completed or canceled. Each interactive session unit is set to 15 minutes long. An Optimum Wellness consultants’ schedule is divided into three 20 minute segments per hour. Out of each 20 minute segment, a maximum interactive time of 15 minutes is allowed with a 5 minute window. Only time slots made available by an Optimum Wellness consultant may be booked by a client.
Activating a session
To start an interactive session, you will have to be logged in to NatureMDs and click the activation link on your profile home page. This link will appear 1 minute prior to your scheduled session is set to begin. Once you have clicked this link you will need to agree to the terms and condition and enter a Captcha code. Failing to do so will result in a ‘no show’ on your part all you will be charged in full for this session.
Technical Considerations
In order to use the interactive webcam sessions a client must have a webcam, a microphone, a preinstalled version of Flash Media Player (http://get.adobe.com/flashplayer/), enabled pop-ups for NatureMDs and high speed internet connection. Even with all these requirements met, NatureMDs cannot guarantee the quality of a webcam session. NatureMDs is always trying to upgrade the service quality and use the latest software, however, delays, echoes and other interferences might be experienced. NatureMDs strongly recommends the use of a headset for all online sessions.
Summary and Treatment Plan
After each interactive session your Optimum Wellness consultant might recommend a treatment plan for you in which you are advised to follow some courses of action. You agree to fully and carefully read all provided information in this plan and contact your primary care doctor if you have any related questions. NatureMDs is not responsible for the content or the quality of any advice or treatment plans recommended by Optimum Wellness consultants’ to patients. If you have further concerns regarding the content or quality of the treatment plan you should consult with your primary care doctor about it.
Personal messages
Communicating with an Optimum Wellness consultant is possible via the NatureMDs message system. Using this message system is dependent on your agreeing to the terms and conditions.
In order to send a personal message you will need to have sufficient credits in your account. Once you have sent your personal message to your selected Optimum Wellness consultant, these credits will be ‘frozen’ until you have received a reply from your Optimum Wellness consultant. Not all personal message replies by your Optimum Wellness consultant will be charged for. You will be charged for in depth responses and treatment plans. If the reply is a short reply or to clarify a query you will not be charged. If you think you have been charged unfairly, please solve this matter directly with your Optimum Wellness consultant via the ‘I have been charged unfairly’ link. NatureMDs cannot guarantee a reply time to your personal messages by Optimum Wellness consultants; however, this is usually within 24 hours.
Charging Rules (Fees, Reserved Credits, Cancellations and Refunds)
Fees
NatureMDs works on a credit based system. To use any of the NatureMDs services’ you will have to purchase credits prior to scheduling an interactive session or requesting a personal message.
10 credits are needed for an interactive session.
20 credits are needed for an emergency session.
5 credits are needed for a personal message.
The cost of a single credit is $5
Reserved Credits
When booking an interactive session or an emergency session, the appropriate amount of credits will be 'Reserved' in your account for this session. These reserved credits will be locked until the session is either completed or canceled and cannot be used for any other purpose.
Credits will also be reserved in your account for messages you send. If your Optimum Wellness consultant charges you for a message your reserved credits will be charged from your account. If the message reply is a non-charged message, your reserved credits will be unlocked and returned to your available credits.
Cancellations
If a client cancels an Interactive session:
Cancellation of a scheduled interactive session is possible, and will result in no charge, if you cancel more than 24 hours prior to the scheduled interactive session. Should you cancel a scheduled interactive session between 12-24 hours before the time of the scheduled interactive session you will be charged 2 credits. Should you cancel a scheduled interactive session between less than 12 hours from the time of the scheduled interactive session you will be charged 4 credits. Cancelling an emergency session will result in a lose of 8 credits.
If an Optimum Wellness consultant cancels an Interactive session:
Should your Optimum Wellness consultant cancel an interactive session 24 hours prior to the scheduled interactive session you will not be charged or awarded any credits. Should the Optimum Wellness consultant cancel the interactive session between 12-24 prior to the scheduled interactive session time, you will not be charged any credits and will be awarded 1 free credit. Should the Optimum Wellness consultant cancel the interactive session less than 12 hours prior to the scheduled interactive session time, you will not be charged any credits and will be awarded 2 free credits. Should the Optimum Wellness consultant cancel an emergency session you will not be charged any credits and will be awarded 4 free credits.
Should your scheduled session not take place due to technical reasons on the NatureMDs site (planned maintenance, server down, power failure, site bugs, hacking attempts, script errors) you will not be charged or awarded any credits. A new interactive session will have to be scheduled with your Optimum Wellness consultant.
Refunds
You are entitled to a full refund on purchases of 3 credits or more, within 14 days of your purchase provided that none of the credits have been used. Refunds exclude handling fees and are subject to a processing fee of $10.00 USD.
NatureMDs does not offer any refunds for completed services. Should you be dissatisfied with your Optimum Wellness consultants’ advice or recommendations you will need to discuss this directly with your Optimum Wellness consultant.
Indemnity
You agree to defend, indemnify, and hold NatureMDs, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.
Use of Content
NatureMDs authorizes you to view or download a single copy of the material on the NatureMDs Site that you are expressly authorized to access solely for your personal, noncommercial use. The Content is protected by international copyright laws. Title to the Content remains with NatureMDs or its licensors. Any use of the Content not expressly permitted by these Terms and Conditions is a breach of these Terms and Conditions and may violate copyright, trademark, and other laws. Content and features are subject to change or termination without notice in the editorial discretion of NatureMDs. All rights not expressly granted herein are reserved to NatureMDs and its licensors.
If you violate any of these Terms and Conditions, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.
Although NatureMDs cannot monitor the conduct of its members off the Website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any member without their prior explicit consent.
General
The following provisions survive the expiration or termination of this Agreement for any reason whatsoever: Liability, User Submissions, User Submissions – image, video, audio files, Indemnity, Jurisdiction, and Complete Agreement.

NatureMDs and its co-branders, suppliers, licensors, and other related parties, and their respective officers, agents, representatives, and employees expressly disclaim all warranties of any kind, whether express, statutory or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, accuracy of data and non-infringement. Because some jurisdictions may not permit the exclusion of certain warranties, some of these exclusions may not apply to you.
2. NatureMDs and its co-branders, suppliers, licensors, and other related parties, and their respective officers, agents, representatives, and employees make no warranty that (i) our site will meet your requirements, (ii) materials, software or content available for download from the site are free of infection or viruses, worms, Trojan horses, or other code that manifests contaminating or destructive properties; (iii) our site will be uninterrupted, timely, secure (including free from unauthorized access), provide continuous storage or access, or error-free, (iv) the results that may be obtained from the use of our site will be accurate, complete or reliable, (v) the quality of any products, services, software, information, or other material purchased or obtained by you through our site will meet your expectations, and (vi) any errors in our site or software will be corrected.
3. Any material downloaded, uploaded or otherwise obtained through the use of our site or software is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or business or loss of data that results from the download or upload of any such material or the use of our site or our software.
4. No advice or information, whether oral or written, obtained by you from NatureMDs or through or from our site shall create any warranty. Advice or information received by means of our site should not be relied upon for significant personal, business, medical, legal or financial decisions and you should consult an appropriate professional for specific advice tailored to your particular situation.
Complete Agreement
Except as expressly provided in a particular "legal notice" on the NatureMDs website, these Terms and Conditions, NatureMDs Charging Rules and the NatureMDs Privacy Policy constitute the entire agreement between you and NatureMDs with respect to the use of the Site, and it’s Content.
